Nov 27, 2021

A tragic crash has claimed the life of a 9-year-old child, according to sources in Lakewood. The New Jersey State Police responded to the crash and are still trying to determine the cause of the auto accident. No charges have been filed as information continues to be collected.

What Reportedly Took Place at The Accident Scene?

According to the very limited information gathered by police so far, it appears that, around 10:17 p.m. the night of Nov. 21, a single vehicle was traveling on entrance ramp 89A toward GSP south when the accident happened. For reasons that have yet to be determined, the vehicle left the road before overturning. A 9-year-old boy from Beachwood sustained fatal injuries after being ejected from the vehicle. He was pronounced dead.

No information was provided about the driver or any other passengers who might have been in the vehicle. Police have not ruled out negligence, recklessness or even intoxication at this point. The crash will remain under investigation until such time as these questions are answered to the satisfaction of law enforcement.

Those Who Lose Loved Ones in These Instances Have Legal Rights

Depending on the outcome of this investigation, the driver (should they have survived) may face criminal charges for their role in the auto accident leading to the child’s death. New Jersey law also allows the family of the child to file further civil complaints in the form of a wrongful death lawsuit. This can even occur if the driver and the child share a familial relationship.

New Jersey is in the midst of a population boom. As more and more people move here, roadways will become increasingly crowded. Overcrowded roadways are a recipe for auto accidents. These days, just going for a short drive can potentially result in a serious or fatal crash. Drivers must stay focused at all times behind the wheel. Two-Vehicle Crash Recently, a two-vehicle crash in Toms River resulted in the death of one person and critically injured two others. The accident happened during the morning hours at the intersection of Route 37 and Oak Ridge Parkway. According to reports, the driver of a westbound vehicle was traveling at a high rate of speed on Route 37 and ran the red light at the intersection. Reports said the westbound vehicle slammed into a vehicle that was headed south on Oak Ridge Parkway. Tragedy Authorities said two occupants in the southbound vehicle were critically injured and rushed to a local hospital. Reportedly, the driver of the westbound vehicle was also badly injured and died a short time later at the hospital. Police said this was the third fatal crash so far this year on Route 37 in Toms River. Motor vehicle accidents are one of the leading causes of injury and death across the country. A serious or fatal auto accident can happen without warning and in the blink of an eye. Those in New Jersey who have suffered injuries or the loss of a loved one due to negligence in auto accidents have the right to pursue damages by contacting a skilled litigator. A lawsuit, if successful, can supply victims and families with much needed and deserved compensation.

An underage woman has been arrested after allegedly crashing her vehicle while under the influence of alcohol, according to local law enforcement. Police in Berkeley Township, New Jersey, conducted the arrest of the 20-year-old woman. She now faces DUI charges among several other traffic-related offenses. What Reportedly Happened? The information provided in the report is incomplete, but it appears that, at around 1:45 a.m. the morning of Nov. 1, police responded to reports of an accident on Hickory Lane and Route 9. When they arrived, they found the 20-year-old driver had struck a utility pole with enough force to sever the pole from its base. The pole fell onto Buckley Lane and also caused a power surge that disabled several traffic lights. The road was closed for several hours as a result of the damage. The driver was injured in the crash, but the type and severity of her injuries were not reported. She was arrested on site and charged with reckless and careless driving, failure to maintain a lane, failure to produce insurance and DUI. The report did not mention what led officers to charge her with DUI, as there was no mention of roadside, breath or blood testing. Help and Support Is Available when Facing These Charges A DUI charge is enough for a New Jersey resident to lose her license, and possibly her freedom as well. This is why her defense attorney will carefully review the details of her case, particularly the events of the investigation and her subsequent arrest. If police did not follow due process or in any way infringed on the woman’s rights during this process, the charges could be reduced or the case thrown out entirely.

A 36-year-old Flemington man was taken into custody following a serious accident that damaged three different vehicles on Oct. 16. The New Jersey man allegedly attempted to disguise himself as a passenger in one of the vehicles before being apprehended. The man faces multiple charges, including DUI and related infractions. The investigation is still underway, and police have asked for the support of the community in determining the specifics of the accident. What Reportedly Took Place at The Scene? According to the current report, it appears a crash involving three cars was reported on Main Street, though the details of the crash were not mentioned. When police arrived, they found the 35-year-old suspect in the back of one of the three vehicles. He told police he was a passenger and that the driver responsible for the crash had fled the scene before they arrived. However, witness statements and video footage reviewed by officers apparently showed the suspected man had been driving when the crash took place. He was subsequently arrested and charged with DUI, failure to report a motor vehicle accident, hindering apprehension, reckless driving and multiple other charges. If he is found guilty, he could lose his license, be required to pay fines or even spend time in jail. Everyone Has Rights when Facing These Charges DUI charges are not always easy to prove, and in this situation, it will be incumbent upon New Jersey prosecutors to prove beyond reasonable doubt the man was intoxicated at the time of the crash. This will require evidence to be presented in the form of breath or blood testing, though neither of these represents infallible proof of intoxication. The complexity of such cases is a primary reason why the accused man will be represented by a criminal defense attorney in court.

Washington Township gave witness to two separate arrests in the early mornings of Oct. 2 and 3, respectively. New Jersey authorities have reported that two men, both suspected of DUI, were arrested and charged following separate accidents . Neither man appears to be in police custody at this time, and no trial dates have been publicly announced at this time. What Reportedly Took Place at Each Incident? According to separate reports filed across two days, the first incident took place at around 4 a.m. the morning of Oct. 2. A man who has not been identified publicly by police was found to have crashed his vehicle into a utility pole. He was arrested at the scene and charged with reckless driving, failure to maintain a lane and driving under the influence. The second man, also unidentified by police at this time, was arrested the following morning around 1 a.m. while traveling on Route 46. The man faces charges of speeding, reckless driving, driving with an expired registration and driving under the influence. Neither report mentioned what roadside sobriety testing if any, took place in either case, and police have not elaborated on why the officers on the scene believed the men to be intoxicated. Legal Support Moving Forward This is partially why DUI charges can be complicated when brought before a New Jersey criminal court. Many factors must be taken into consideration in such a case, which is why the defense attorneys representing the two men will carefully review the facts of the case. This may include interviews with the accused men as well as a thorough review of the police reports filed in connection with each case.

Taking prescription medication is something that many people in New Jersey do in order to maintain their health. While these prescriptions in and of themselves are not inherently illegal, laws do exist against individuals possessing prescription medication without a valid prescription or in amounts that exceed their prescription. If authorities find you or a loved one in possession of a prescription drug without valid reason, you could face serious criminal charges. It is also important to note that you could face misdemeanor or felony charges if you have a valid prescription but possess the substance without proof of that prescription. Law enforcement takes drug possession seriously, and in the event that such charges come against you, preparing thoroughly may be of use to you. Why Is Prescription Drug Possession Illegal? Though the drugs themselves may not be illegal to take in a general medical sense, most prescription medications are illegal to possess without a doctor’s approval and recommendation. Many medications have serious side effects, including possible addiction, that could seriously harm a person if taken incorrectly or without proper supervision. In particular, opioids have a high risk of addiction, and abuse of such drugs have reached epidemic levels throughout the United States. In efforts to curb such abuse, laws are in place for managing the use of these medications. What Issues Could Result from Possession? The exact outcomes of a charge for prescription drug possession vary from case to case. However, financial penalties, as well as time in jail, are not unheard of in such cases. In fact, such outcomes are common. Still, your exact case will depend on a variety of factors, including the following examples: The amount of the substance in your possession Whether authorities suspect you obtained the substance through illegal means Whether authorities suspect you of distributing the substance The type of prescription involved Fully understanding the specifics of your case could help you as you work toward creating a meaningful defense. Though criminal charges for drug possession may seem bleak, you are not without options. Possibly, a thorough assessment of your situation may uncover details that could help lessen the charges or even have them dropped completely. However, such outcomes are not a guarantee, so exploring your available defense strategies that suit the circumstances of your case may prove best.

Two people were hurt in a single-vehicle accident in Hammondtown, according to local sources. New Jersey news sources say the driver and passenger were injured in the auto accident that required both individuals to be immediately hospitalized. Winslow Township Fire Department is working with the local highway safety unit to determine the cause of the crash. What Apparently Happened According to the report, the vehicle was carrying a 34-year-old male driver and a 22-year-old female passenger in the front seat. Around 2 a.m. the morning of Aug. 20, for reasons that have yet to be determined, their vehicle was traveling on Waterford Road when it veered off into a wooded area. The car struck a tree with considerable force. The passenger was partly ejected from the vehicle and was airlifted by helicopter to a nearby hospital. The driver had to be extricated from the vehicle by emergency crews, illustrating the damage done to the vehicle. He was taken to the same hospital by ground ambulance. Neither individual’s injuries have been reported upon, but it can be assumed they may be severe. Seeking Legal Support in The Aftermath of These Incidents Finding the cause of a single-vehicle auto accident may seem simpler than a crash involving multiple vehicles, but the fact is there can be a variety of factors that influence even a single driver. If the investigation reveals the driver was reckless, negligent or even intoxicated, leading to the crash, he may find himself subject to criminal charges. Separately, even if no charges are filed, his injured passenger is entitled to file a personal injury suit against him in a New Jersey civil court.

Any number of issues might prompt a New Jersey police officer to make a traffic stop. If an officer witnesses erratic driving behavior, he or she might suspect that the person behind the wheel is intoxicated. A patrol officer might then ask the driver to step out of his or her vehicle for a preliminary alcohol screening. Police Might Request a Field Sobriety Test In addition to requesting a roadside breath test to see if the device detects alcohol on the breath, an officer making a traffic stop for suspected DUI might also ask a driver to submit to a field sobriety test. Several types of tests help determine if there is probable cause to make a DUI arrest . The following list briefly explains three of the most common types of field sobriety tests: A horizontal gaze nystagmus test tracks a person’s eye movements as he or she follows an object without moving his or her head to check if there is erratic eye movement before reaching the maximum peripheral vision point. The one-leg stance test typically involves standing on one leg with the head tilted upward with arms in a relaxed position; the person might also be asked to count aloud by 100s or 1000s, etc., while standing on one leg. A walk-and-turn test requires a person to hold arms out at shoulder length while walking a straight line with the heel of one-foot meeting at the toe of the other with every step. A field sobriety test enables a police officer to observe whether the person taking the test can follow a series of simple instructions and perform physical tasks without error. An officer’s personal interpretation of events influences the results of the test and may lead to a DUI arrest if a failing score is given. Every Person Is Guaranteed an Opportunity to Refute DUI Charges in Court A New Jersey motorist is not obligated to take a field sobriety test. If a person submits to such a test and fails, he or she might wind up facing criminal charges and can refute the charges in court by presenting a defense. Most defendants request legal representation to help them determine which type of DUI defense strategy might be best in a specific set of circumstances.
